Dan Fiorito

Attorney at Law

Dan N. Fiorito III is a seasoned trial lawyer who represents clients across Washington in medical malpractice, serious personal injury, and civil rights litigation. Based in Seattle, Dan advocates for individuals and families who have suffered catastrophic harm due to medical errors, major accidents, unsafe premises, and government misconduct.

With over 20 years of courtroom experience spanning both state and federal courts, Dan brings a unique and powerful combination to the table. He began his career as a Deputy Prosecuting Attorney in Pierce County and then served as a defense lawyer for hospitals and physicians. Today, he leverages that insider perspective to hold powerful institutions accountable on behalf of seriously injured clients.

"I want to provide a voice to those who think that no one else is listening."

Expertise & Trial Practice

Dan’s litigation work focuses on:

  • Medical Malpractice – including surgical errors, misdiagnoses, delayed treatment, and hospital negligence

  • Serious Personal Injury – including major auto collisions, construction accidents, and premises liability

  • Wrongful Death – representing families who have lost loved ones due to negligence or systemic failure

  • Civil Rights & Section 1983 Litigation – including in-custody medical neglect, police misconduct, and unlawful arrest

  • Government & FTCA Claims – representing clients injured by government agencies and employees

Dan successfully argued before the Washington Supreme Court in Martin v. Department of Corrections, securing a constitutional victory for patients harmed by state-employed healthcare providers. The Court struck down an unjust “certificate of merit” requirement for government institutions, affirming patients' rights to pursue justice without arbitrary barriers.

Personal Resilience & Focus

Dan has climbed both Mount Rainier and Denali, the highest peaks in Washington State and North America respectively. Those climbs demanded intense preparation, mental toughness, and the ability to navigate risk under pressure—qualities that define his approach to litigation. Whether facing a complex medical malpractice case or a high-stakes civil rights trial, Dan brings the same mindset: stay focused, prepare deeply, and keep pushing forward when the stakes are highest.
